CDF: Victory in Mosgorsud in Trial Deadline Failure Case

On September 5 Mosgorsud delivered a judgement regarding a CDF client rights for criminal trial within a reasonable time violation. The client has fallen victim to a $3 m fraud case. The damages recovered from the Ministry of Finance of the Russian Federation and the Ministry of Internal Affairs of the Russian Federation amounted to 90 thousand rubles plus court costs.

According to the Supreme Court of the Russian Federation statistics, only 12% of similar cases get favourable decisions. The damages of over 10 thousand rubles are recovered only in 8% of the cases.

Daniil Gorkov, CDF lawyer, who represented interests of the client in Mosgorsud, noted, ‘A deep analysis of the criminal case files, building a legal position, and the client’s preparations for a trial presentation formed a ground for our victory, but the main part still lies ahead. In the foreseeable future we are planning to press charges against those responsible and compensate for damages. The work continues!’
